ENGLAND & WALES BOOKING TERMS & CONDITIONS

1. Advance Rent Payment
  • At the time of applying, you will make an Advance Rental Payment. This constitutes your acceptance that the Advance Rental Payment is retained to secure your room in accordance with these terms and conditions.
  • If you have paid an Advance Rental Payment, this will be treated as a payment towards your first rental payment and will be credited to your rent account.
  • Your Advance Rent Payment is payable to secure your room and we will hold your chosen room for you on the basis that you enter into a Tenancy Agreement within 7 days of receipt of the Advanced Rental Payment.
  • The Advanced Rental Payment is non-refundable unless in the event of a cancellation within the 7 day cooling off period or you meet one of the circumstances outlined in section 4 (Cancellation outside of the 7 day cooling off period).
  • If you booked before the 8th April 2024 your advanced rent payment will equate to 1 weeks rent. If you have booked after the 8th April 2024 your advanced rent payment will equate to £150. Both amounts will be deducted from your first instalment of rent in August.
  • If you have rebooked a room with us for the next academic year before the 8th April 2024 your advanced rent will equate to 1 weeks rent. If you have rebooked a room with us for the next academic year after the 8th April 2024 your advanced rent payment will equate to £1. Both amounts will be deducted from your first instalment of rent in August.
2. Application Screening
  • You give us express consent to use the details provided by you to undertake searches against sanctions lists, including those maintained by the United Kingdom, the United States, the European Union (“Sanctions Lists”); and
  • background checks, including but not limited to searches against United Kingdom law enforcement databases (“Law Enforcement Databases”),

Screening Searches

  • You acknowledge that we may need to request additional information to verify your identity in connection with the Screening Searches (“Screening Search Additional Information Request”). You agree to cooperate with any Additional Information Request(s).The undertaking of Screening Searches and/or any associated Screening Search Additional Information Request(s) will not affect your rights and/or our obligations to you under the Data Protection Act 2018.
  • You have the right to ask us not to undertake Screening Searches but in doing so we will not be able to progress your application.
3. Cancellation- Within the 7 day ‘cooling off period’
  • We operate a 7 day ‘cooling off period’ upon receipt of the Advance Rental Payment.
  • If you cancel within this 7-day period, your Advance Rental Payment will be refunded to you.
  • You will no longer be liable for the contractual obligations as set out in your tenancy agreement.
4. Cancellation- Outside of the 7 day ‘cooling off period’

If you wish to cancel your booking after the 7-day cooling off period, you will remain liable for the contractual obligation set out in the tenancy agreement.

Exceptions to this may be considered if proof is offered under the following circumstances:

  • Your UK Visa application has been denied.
  • You have failed to obtain the required qualifications to get into your first University of choice or;
  • Extenuating circumstances e.g., ill-health, family circumstances.

If you have failed to obtain your grades or your UK visa has been denied, then you must provide proof emailed to site within 72 hours. Upon receipt of the proof your booking will be cancelled, and we will refund your Advance Rental Payment. You will no longer be liable for the contractual obligations in your tenancy agreement.

If your reason for cancelling is extenuating circumstances, then proof must be emailed to site and then your request to cancel will be considered. Please be aware we are under no obligation to cancel under extenuating circumstances, and these will be dealt with on a case-by-case basis.

If you fail to send the proof within the 72-hour timescale, your Advanced Rental Payment will be retained.

If you fail to tell us until after the tenancy commencement date you will be liable for the full contract.

All requests to cancel a booking must be made in writing via email to the site you have booked or by emailing [email protected].

5. Cancellation after keys collected or commencement of the tenancy.
    • Once you have collected your keys or your tenancy start date has commenced you lose the right to cancel your tenancy. You are liable for the full rent unless a suitable replacement is found to take over your tenancy and its contractual obligations.
    • You agree that you shall not transfer or sublet your tenancy to anyone else without obtaining written consent from Abodus Student Living.
    • Only when a suitable replacement has been found and they have completed their booking, passed our checks, and paid any rent due will you be eligible to be released from the tenancy liability.
    • For the avoidance of doubt, you are liable for any rental from the start of your tenancy to the day before the new replacement tenancy begins.
    • Once it has been confirmed you can be released from your liability, we will then process the refund of any overpaid rental (if applicable) including your Advance Rental Payment.
    • Any refunds due will not be processed until the replacement occupier has collected keys and checked in.
    • If you fail to find anyone to replacement your tenancy you remain liable for the full agreement and any contractual obligations as outlined including all rental due as stated.
    • If you have withdrawn from university due to extenuating circumstances, please speak to the site accommodation team for further advice.

    6. Cancellation by us.

Abodus Student Living or the Landlord reserve the right to cancel your booking prior to you collecting your keys under the following circumstances:

  • We take all reasonable steps to enter into the Tenancy Agreement before the deadline and you fail to do so, for example, if you fail to complete your application or provide guarantor details and supporting documentation in good time.
  • You provide false or misleading information.
  • We have determined following undertaking screening searches that you appear on sanctions lists and/or law enforcement databases.
  • We are prohibited from entering to the Tenancy Agreement with you because of the Immigration Act 2014 (persons disqualified by immigration status). In this case we can cancel your booking for this reason, you will not be liable for the contractual obligations laid out in the Tenancy Agreement from the date of cancellation, irrespective of whether you have signed it.
  • You fail to co-operate with any screening searches or additional information requests.
  • You have not paid any rental or charge amounts due either from a previous tenancy with Abodus Student Living or for your pending tenancy with Abodus Student Living.
7. What if I booked as part of my University?

If you have booked with your university as part of a nominations, the terms and conditions may vary; please contact your site accommodation team for more information.

8. Room & Tenancy Changes

Tenancy Lengths

If you wish to change your tenancy length, you will be unable to shorten your tenancy, but you can choose to extend without charge up until the Tenancy Start Date (Subject to room availability).

Tenancy Start Date

If you wish to change your tenancy start date, then please contact your site accommodation team.

Room Swaps

If you wish to upgrade your room, or move to a different room type, which is the same type as your original choice, you can do so free of charge up until the Tenancy Start Date, subject to room availability.

Governing Law

These terms and conditions (including any claims or disputes relating thereto) shall be governed by and construed in accordance with the laws of England and Wales. The Parties irrevocably submit to the exclusive jurisdiction of the English courts over any claim, dispute or other matter arising under or in connection with these terms.

SCOTLAND BOOKING TERMS & CONDITIONS

Advance Rent Payment

SUMMER & SHORT STAYS

Student Summer Accommodation 

Abodus is now accepting bookings for students wishing to stay at one of our properties over summer. These bookings are outside of the normal academic year contract and pricing structure as operated by Abodus Student Living.

Summer prices do not include any other offers or incentives. All short-term contracts are subject to availability to be confirmed by the Abodus team.

Short Term Booking

A short-term booking is not restricted to the summer period; it can occur at any point during the year as agreed with Abodus. The contract length for a short-term booking and pricing are outside of the normal academic year contract.

OFFERS TERMS & CONDITIONS

General Terms & Conditions

  1. If a prize is available, no alternative prize, or cash alternative will be available unless specified in writing.
  2. Entries must be made by a current resident in an Abodus Student Living property unless specified as open to any other external entrants.
  3. The competition will open and close on specified dates.
  4. Where a hashtag is required as detailed in the competition, no entries will be accepted if they do not use the correct hashtag.
  5. In accepting any prize, the winner consents to Abodus Student Living including them in publicity on the Abodus Student Living website and its social media platforms.
  6. The winner must contact Abodus Student Living as detailed in the competition in order to claim their prize.
Promotion Terms & Conditions 2023/24 & 2024/25
General Promotional Offer Terms & Conditions
  1. Offers are subject to availability and are subject to change or removal without prior notice.
  2. Promotions and incentives are only valid if the claiming student satisfies the requirements which includes moving into the property and paying the first instalment of rent.
  3. Offers start and finish on confirmed dates, any bookings outside of these dates are not eligible for the offer.
  4. The student must claim their booking incentive by the agreed date supplied to the student by the site team in the academic year the incentive applies to. If the incentive has not been received by the agreed date, the student must highlight this in writing to the Operations Manager. Incentives not received without notification to the Operation Manager become invalid.
  5. All booking incentives must be logged with the correct, valid promo code at the point of application. No incentives will be paid or issued without the relevant code.
  6. Offers are only applicable to a student’s booking once they have fully completed their application, including deposit paid and signed by guarantor. An offer won’t be applied to a student’s booking until all this criteria is met.
Refer a Friend Incentive
Refer a Friend –
  1. The Refer a Friend Incentive (Reward) varies year on year and across different properties (where applicable); to be paid to both the student who has booked with Abodus Student Living for the pertinent academic year [the Referrer] and their friend [the Referee] who does not currently live at an Abodus Student Living site. The Referrer can be a current resident with Abodus Student Living, or booking with Abodus for the first time. The Referee must be a new booker, they cannot have lived with Abodus Student Living before.
  2. This Incentive (reward) is only applicable to Abodus Student Living accommodations/building that are promoting this incentive (reward) not all locations are eligible for this.
  3. This Reward can be used with the cash back offer if applicable, but not used in conjunction with any other offer.
  4. The Reward is limited in numbers and once reached the offer will be withdrawn.
  5. To be eligible for the Reward the Referrer & Referee must have completed and signed their tenancy agreement along with guarantor, paid their first rental instalment and moved into the property.
  6. The Reward will not be paid if either the Referrer or Referee’s rent account is in arrears. Abodus Student Living reserves the right to refuse this offer to existing customers who are in breach of their tenancy.
  7. To qualify for the Reward (and subject to vouchers being available), the Referrer should ask their friend to quote the Referrer’s name when booking. The offer cannot be applied retrospectively once the booking has been made. It is essential first/last names are spelt correctly.
  8. The offer is available online and for bookings made at Abodus Student Living accommodation reception or by telephone.
  9. An unlimited number of friends may be referred (subject to vouchers being available).
  10. No cash alternative to the voucher will be offered. The vouchers are not transferrable. We reserve the right to substitute any voucher with another of equivalent value without giving notice.
  11. The reward will be given to all eligible students on or before the agreed date communicated via the site team.
  12. The Reward will only be eligible to students who pay their first rent instalment in full, by 31st October. Any late payments after 31st October will not receive the Reward.
  13. The Reward is being managed by Abodus Student Living, who reserves the right to suspend, cancel or modify the incentive at any time (and for any reason) without notice.
  14. Abodus’s decision in respect of all matters to do with the incentive will be final and no correspondence will be entered into.
  15. This Reward is not to be used in conjunction with any other incentives offered by Abodus or any other third-party booking agents such as international agents.
  16. The Reward is being offered by Abodus Student Living.
  17. Abodus Student Living reserves the right to cancel or amend any or all parts of the offer and its terms and conditions without notice for any reason that is outside of our control.
  18. Abodus Student Living reserves the right to cancel or amend any or all parts of the offer if it is deemed student/s are taking unreasonable advantage of the Reward.
  19. This offer is only available for students with a signed and fully complete tenancy agreement on a 43-week, 44-week 50-week or 51-week contract
Rebooker & Cashback Incentives
Cashback Offer
  1. The Cashback incentive (Reward) is open to any student who books a room with Abodus Student Living, during the given period at the Abodus Student Accommodation Building that is running this incentive only.
  2. The Reward is limited and will be withdrawn once the number of available offers has been reached. Applications for room bookings received after this time will not be eligible for the Reward.
  3. This offer is only available for students with a signed and fully complete tenancy agreement on a 43-week, 44-week 50-week or 51-week contract.
  4. The Reward is subject to room availability.
  5. To be eligible for the Reward students must have completed and signed their tenancy agreement along with guarantor, paid their first rental instalment and moved into the property.
  6. Only one offer is redeemable per booking.
  7. This offer is not applicable for those coming through university nominations or referrals.
  8. Should a student withdraw from university in line with the cancellation policy they will not be entitled to any cashback offer.
  9. Should a student be released from their contract for exceptional circumstances, the cash back they will be entitled to will be pro rota. This will be calculated in term dates, not calendar weeks.
  10. To claim the Reward

a) On receipt of the application from the Student, the Accommodation Manager will verify the student’s eligibility to claim the Reward.

b) The Reward will be credited back to the student’s nominated bank account by the agreed date communicated to the eligible students and after the Landlord has received the first full rent instalment.

c) Only students who pay their first rent instalment in full, by the end of October at the latest will be eligible for the reward. Any late payments after the 1st of November will not receive the cash back reward.

  1. Should the student be in rent arrears by the deadline of the 1st of November, the cash back payment will not be paid.
  2. The Reward is being managed by Abodus Student Living, who reserves the right to suspend, cancel or modify the incentive at any time (and for any reason) without notice.
  3. Abodus’s decision in respect of all matters to do with the incentive will be final and no correspondence will be entered into.
  4. This Reward is not to be used in conjunction with any other incentives offered by Abodus or any other third-party booking agents such as international agents.
  5. The Reward is being offered by Abodus Student Living.
  6. Abodus Student Living reserves the right to cancel or amend any or all part of the offer and its terms and conditions without notice for any reason that is outside of Our control.

  6. This offer is based on 1 wash and dry per week for the 51 weeks of tenancy length which equates to a total of £306 per person.
  7. This offer is applicable to all room types at selected sites

The photography and images used to advertise a property on our website are a representative of that property. Individual rooms types, floorplans and contents in the room may differ.

Where properties are under development and construction, we will use computer-generated images (CGI’s) to represent what the property will look like when it is completed.

Image, video or statement testimonials of any student featured in the Abodus website or Abodus advertising campaigns are following voluntary agreements to be featured and belong strictly to Abodus

The room furnishings shown in photography, images and videos will not always be representative of what is included.

Third Party Websites

Abodus Student Living do not accept responsibility for any errors or incorrect information shown on any website that is not owned and operated by Abodus Student Living.  Therefore, we are not bound to honour any rates or information displayed on a third-party website or social media platform where it differs from that shown on the Abodus Student Living website.
